Contract with VocaleApp
Your contract with VocaleApp is constituted by the terms set out in this document. In case of contradiction between the policies of fair use or any additional conditions and this document, this document will prevail.
Acceptance of terms
These conditions are accepted by you when you use VocaleApp products and/or websites.
You can not accept these terms if you are not legally authorized to use VocaleApp products or/and websites in the country where you are resident.
Change of terms
Changes take effect as soon as they are published. Please check the terms regulary. You understand and agree that your explicit acceptance of products and/or websites terms after the date of publication constitutes acceptance of the updated terms. If you do not agree with the modified terms, you can not use VocaleApp produtcs and/or website.
End of your relationship with VocaleApp
You can end your relationship with VocaleApp at any time and without recourse to the courts by asking the closure of your user account to our support team.
VocaleApp may end the relationship with you or may supend your use of your VocaleApp user accounts, products and/or website at any time and without recourse to the courts.
VocaleApp agrees to respect your privacy and the confidentiality of your personal information. We will treat your personal information, traffic data and the content of your communications in accordance with applicable law.
Applicable law and competent court
These conditions are subject to French law. In the event of a dispute, an amicable solution will be sought beforehand. Any dispute relating to the execution of these conditions will fall under the exclusive jurisdiction of the French courts.
By using products and/or VocaleApp websites undertake, cause, permit, or permit the change, creation of derivative works or improvements, translation, reverse engineering, decompilation, disassembly, decryption, emulation, piracy, discovery or attempt to discovery of source code or products protocols of VocaleApp produtcs and/or website or any part thereof or function thereof and to use them within or for the supply or commercial goods or services.
Uses of VocaleApp products and/or websites
You are agree that VocaleApp may somtimes need to perform maintenance or upgrade of VocaleApp produtcs and/or websites or the underlying infrastructure that allow you to use VocaleApp products and/or websites.
VocaleApp may be forced to temporarily suspend or limit use of any or all VocaleApp products and/or websites until this maintenance and/or upgrade has been completed. Wherever possible and unless emergency response is required VocaleApp will publish in advance the date and time of the suspension or limition on VocaleApp website. You can not claim any damages for such suspension or limitation of the use of a products and/or VocaleApp website or whatever.
Services quality of VocaleApp
VocaleApp can not guarantee that VocaleApp products or/and websites will always work without disruption, delay or error. A number of factors can affect the quality of your communications and the use of products (depending on the products used) and/or VocaleApp websites, and may result in the failure of your communication. VocaleApp assumes no responsibility and you will not be able to claim or claim any damages for any disruption, interruption or delay caused by a failure or insufficiency of any of these elements or any other element over wich we have no control.
Changes of VocaleApp products and services
VocaleApp constantly improves the products and services provided, and may also need to change the technical specifications sometimes in order to comply with applicable regulations. As a result, you acknowledge and agree that products, services and features may vary sometimes. The technical requirements for use of the products, and the descriptions of the feature are available on VocaleApp website. If you disagree with some of the changes to the products, you can end your relationsheep with VocaleApp.
Before your first use of VocaleApp products and services, you will be asked to create a user account. You are solely responsible for all activities performed on your user account. To prevent unauthorized use, you must maintain the confidentiality of your PIN and not share it with any third party or use it to access any third party site or service. If you suspect someone else knows your PIN, you must immediately change it to protect your account. VocaleApp assumes no responsability for your failure to comply with the obligations set out in this paragraph.
Exclusive rights and VocaleApp property
The content and compilation of content appearing on VocaleApp websites (excluding user content) such as text, graphics, logos, icons, images, audio clips are the property of VocaleApp. Content protected by copyright may not be reproduced without the express permission of VocaleApp.
Terms of sale
All prices are indicated inclusive of all taxes (T.T.C).
VocaleApp reserves the right to modify its prices or to introduce new charges concerning access to the service at any time.
The payment of your purchases is made only online by credit card. All your purchases are processed and secured via our partners La Caisse D'Epargne & Stripe. You agree to pay for all the services to which you have subscribed.
Your calls are billed per second from the first second. Operator fees may apply for use via 3G/4G connection. Please confirm with your operator VOIP (VOice over IP) usage fee on 3G/4G connection.
Changes of calls rates
VocaleApp may change rates of call at any time without notice by publishing the new rates at www.vocaleapp.com/en/rates/. The new tariff will be applicable immediately after the publication of the new rates. Please check the latest rates before placing your call. If you do not accept the new rates, you can end your relationship with VocaleApp and cannot claim any damages.
Any credit started or recharged for a period of more than 30 days cannot be refunded. A credit not started and recharged for less than 30 days may be refund by making a written request to VocaleApp support via the contact form.
Right to retract
According to article L212-21-8 of the Consumer Code and the immediate execution of your purchase (top-up made and usable immediately 24 hours a day, 7 days a week) you do not have the right to retract.
YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND INCLUDE THE RIGHTS, OBLIGATIONS, CLAUSES BEFORE USING VOCALEAPP PRODUCTS AND SERVICE.
